Buying Property in Antalya: What Real Court Records Teach About Due Diligence

Buying a property in Antalya is not secured by the appearance of the building or by a sales promise alone. Title records, authority to sell, encumbrances, zoning, permitted use and the evidence supporting the transaction should be checked before money or a broad power of attorney is committed.

A title-registration dispute in Antalya

Application No. 2013/3840 arose from a title-registration dispute before the Antalya 8th Civil Court of First Instance. The court record referred to historical maps, aerial photographs, land and cadastral records, witnesses and reports from several technical experts. The case demonstrates why a property dispute may require a complete historical and technical file.

A second warning: intended use is not guaranteed

In Application No. 2017/28373, the dispute concerned land intended for a day-use tourism facility affected by security-zone and land-use restrictions. The Constitutional Court did not find a property-rights violation on the facts presented. For a buyer, the practical point is that a property’s intended tourism or construction use must be checked against official plans, permits and restrictions.

  • Current title record and existing mortgages, annotations or restrictions
  • Seller’s ownership and authority to sign
  • Zoning and permitted use at the relevant municipality
  • Construction, occupancy and licence documents where relevant
  • Payment route, currency, receipt and contract terms
  • The exact scope and duration of any power of attorney
  • Translation and interpretation arrangements for documents signed in Türkiye
