Administrative Detention in Türkiye: What a Real Constitutional Court Decision Shows

A foreign national who is placed in administrative detention in Türkiye may need to deal with detention, deportation and residence issues at the same time. These are distinct measures and should not be treated as one generic immigration problem.
The decision-led starting point
In Application No. 2022/71895, the Constitutional Court examined an Afghan national’s complaint about administrative detention and the effectiveness of the available remedy. The official record states that the Court found a violation of the right to liberty and security.

The procedural warning
The decision explains the specific review route for administrative detention under Article 57 of Law No. 6458. A later claim for compensation does not necessarily replace the obligation to use the designated detention-review procedure. The route and deadline must be checked against the current documents and law.
